Terms of service

These Terms of Service govern your use of tokenbitters.com (the "Website") and any purchase you make from it. The Website is operated by Token Bitters Ltd. ("Token", "we", "us"), 12526 126 Avenue NW, Edmonton, Alberta T5L 3C7.
By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.
1. Who can buy
You must be able to form a binding contract to order from us.
Our mocktails are non-alcoholic. Our cocktail bitters contain alcohol and are sold only to customers who are of legal drinking age in their province of residence. By ordering bitters you confirm that you meet that requirement, and we may decline or cancel an order if we have reason to believe you do not.
2. Where we sell
We currently sell and deliver within Alberta. We may decline orders from outside our delivery area. If you access the Website from elsewhere, you are responsible for complying with the laws that apply to you.
3. Accounts
You can order as a guest. If you create an account, you are responsible for keeping your password confidential and for activity that happens under your account. Tell us at sales@tokenbitters.com if you believe your account has been accessed without your permission.
Wholesale accounts are approved individually and may be subject to a separate account agreement, which prevails over these Terms where the two conflict.
4. Prices and payment
All prices are in Canadian dollars and may change without notice. GST and, where applicable, Alberta container deposits are added at checkout. Container deposits are refundable at any Alberta bottle depot and are not subject to GST.
Wholesale pricing is shown only to approved accounts once signed in. Where a price differs between the public site and a signed-in wholesale account, the signed-in price is the correct one for that account.
You are responsible for paying all amounts due at the time of the order using a valid payment method. Approved wholesale accounts may be granted payment terms, and overdue balances may be referred for collection.
5. Orders
Your order is an offer to buy. We accept it when we confirm dispatch. We may refuse or cancel any order, including where an item is out of stock, where a price or description was published in error, or where we suspect fraud. If we cancel an order you have paid for, we refund it in full.
All sales are subject to availability, which can change during checkout.
6. Product information
We make every effort to describe our products accurately, including ingredients and allergens. Photographs are representative; colour reproduction varies between screens.
Our products are food and beverage products. They are not intended to diagnose, treat, cure or prevent any illness or condition, and nothing on the Website should be read as a health claim. If you have an allergy or a medical condition, read the label on the bottle and consult a professional.
7. Delivery, returns and refunds
Delivery is covered by our Shipping Policy. Returns and refunds are covered by our Return and Refund Policy. Pre-orders are covered by our Purchase options cancellation policy. All three form part of these Terms.
8. Acceptable use
You agree not to use the Website to break the law, infringe anyone's rights, distribute malware, scrape or harvest data, interfere with the site's operation or security, gain unauthorised access, or impersonate anyone. We may suspend or terminate access if you do.
9. Intellectual property
The Website and its contents, including the Token and Distemperance names, logos, label artwork, photography and text, are owned by or licensed to Token Bitters Ltd. and protected by Canadian and international law. You may not reproduce, adapt or distribute them without our written permission.
10. Things you send us
If you send us ideas, suggestions, reviews or other material, you agree we may use them without restriction or compensation, and that we are under no obligation to keep them confidential or to respond. You are responsible for what you send and it must not infringe anyone's rights or be unlawful.
11. Third-party links
The Website may link to sites we do not control. We are not responsible for their content, practices or products. Read their terms before dealing with them.
12. Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
13. Disclaimer
Except as expressly stated in these Terms and to the maximum extent permitted by law, the Website and its content are provided "as is" and without warranty of any kind. We do not warrant that the Website will be uninterrupted, secure or error-free.
Nothing in these Terms limits any warranty, condition or right you have under the Consumer Protection Act (Alberta), the Sale of Goods Act (Alberta), or other applicable consumer protection law that cannot be excluded by agreement.
14. Limitation of liability
To the maximum extent permitted by law, Token Bitters Ltd. and its directors, officers, employees, agents and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Website or our products, including lost profits, lost data or business interruption.
Where we are found liable, our total liability is limited to the amount you paid for the order giving rise to the claim.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence.
15. Indemnity
You agree to indemnify Token Bitters Ltd. against claims brought by a third party arising from your breach of these Terms or your violation of any law or third-party right.
16. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute will be resolved exclusively by the courts of Alberta, and you agree to their jurisdiction.
Nothing in this section removes any right you may have to bring a claim in the province where you live, where consumer protection law gives you that right.
17. General
If any provision of these Terms is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Shipping, Return and Refund, Purchase options cancellation and Privacy policies, are the entire agreement between us regarding the Website.
We may update these Terms. The date at the top shows when they last changed, and continued use of the Website after a change means you accept it.
These Terms have been drawn up in English at the express request of both parties. Les parties conviennent et exigent expressément que ce contrat et tous les documents qui s'y rapportent soient rédigés en anglais.
